Texas Motorcycle Laws: The Basics

While not an exhaustive list, below are some of the most important motorcycle laws to know before going for a ride in Texas:

You Must Have A Class M License

To legally ride a motorcycle on Texas’ public roads, you must have a Class M license. Generally, you must complete and pass an approved safety course to obtain one of these, but for motorcyclists between the ages of 15 and 17, there are additional requirements:

  • They must have completed the classroom portion of driver education (or have a learner’s permit)
  • They must provide proof of enrollment in school, a high school diploma, or a GED
  • They must have parental permission
  • Riders under 16 are limited to an engine size of 250cc
  • They must pass a skills test to receive a license

With regard to that last point, many states require motorcyclists to take skills tests. However, to protect the safety of everyone on the road, Texas, in particular, requires motorcyclists under 18 to pass a motorcycle skills test without exception.

You Might Have To Wear A Helmet

Texas’ laws regarding motorcycle helmets are more complex than those of many other states. Broadly speaking, motorcycle operators and passengers should wear helmets that meet safety standards. If a police officer pulls you over, they may inspect your helmet to ensure it’s compliant with all applicable standards.

If you are 21 or older, you are not required to wear a helmet so long as at least one of the following statements is true:

  • You have taken and passed a state-approved motorcycle safety course

Nevertheless, even if you are not legally obligated to wear a helmet while riding, it’s in your best interests to do so. Helmets reduce fatalities in motorcycle crashes by an estimated 22% to 42%, and they reduce the risk of brain injuries by anywhere from 41% to 69%.

Lane Splitting Is Illegal — But You Can Use The Whole Lane

Lane splitting is a contentious topic. It’s illegal in many states, Texas being one of them. However, because splitting lanes is illegal, Texas motorcyclists have the right to use an entire lane of traffic while riding.

Motorcyclists Have The Same Insurance Requirements As Drivers

Some states have different insurance requirements for motorcyclists than for drivers of passenger vehicles. However, in Texas, insurance coverage requirements are the same:

  • $30,000 liability per person
  • $60,000 liability per accident
  • $25,000 property damage
